- Kazanç müsaderesi; 5237 sayılı yasanın kabulüyle, Türk Ceza Kanunu'nun 55. maddesinde yeni hüküm olarak düzenlenen bir kurumdur. 765 sayılı Türk Ceza Kanunu döneminde yasada ayrı bir kazanç müsaderesi düzenlemesi yer almamıştır. Ancak kazanç müsaderesi, 765 sayılı yasanın 36. maddesinde yer alan suçtan husule gelen eşya cümlesi içinde değerlendirilerek uygulanmıştır. Yeni Türk Ceza Kanun'uyla kazanç müsaderesi açık bir şekilde tanımlandığı gibi, niteliği de açıkça güvenlik tedbiri olarak ifade edilmiştir. Kazanç müsaderesi 5237 sayılı yasada güvenlik tedbiri olarak ifade edilmesine rağmen, kurumun hukuki niteliği açısından öğretide halen tartışmalar devam etmektedir. Kazanç müsaderesi; suçla bağlantılı olarak fail tarafından elde edilen menfaatlerin veya bu menfaatlerin değerlendirilmesiyle oluşturulan malvarlığının mülkiyetinin, kesinleşmiş mahkeme kararıyla devlete geçmesini sağlayan hukuki bir kurumdur. Kazanç müsaderesinin uygulanması için öncelikle fail tarafından gerçekleştirilen tipe uygun hukuka aykırı bir fiil ve bu fiil nedeniyle elde edilen veya suçun konusunu oluşturan ya da suçun işlenmesiyle sağlanan menfaatin varlığı gereklidir. Kazanç müsaderesine etki eden bazı hallerin mevcudiyeti durumunda, kurumun nasıl uygulanacağı da önem arz etmektedir. Örneğin fail bakımından beraat kararı verilmesi halinde kazanç müsaderesi uygulaması mümkün değilken, yaş küçüklüğü nedeniyle hakkında ceza verilmesine yer olmadığı kararı verilen fail bakımından ise kazanç müsaderesi uygulanabilecektir. Kazanç müsaderesine ilişkin yargılama, suçla ilgili yapılan esas yargılamayla birlikte görülebileceği gibi ayrı olarak da görülebilir. Üç bölümden oluşan kitabın ilk bölümünde kazanç müsaderesinin tarihsel gelişimi, genel olarak müsadere çeşitleri, kazanç müsaderesinin benzer kurumlarla ilişkisi, hukuki niteliği ve tanımı, karşılaştırılmalı hukukta kazanç müsaderesinin yeri üzerinde durulmuştur. İkinci bölümde kazanç müsaderesine hâkim olan ilkeler, kazanç müsaderesinin uygulanması için gereken şartlar ve kazanç müsaderesini etkileyen haller açıklanmıştır. Üçüncü ve son bölümde ise muhakeme ve infaz hukuku bakımından kazanç müsaderesinin ve iade yargılamasının nasıl olacağı, ayrıca kararların infazı açısından Suç Eşyası Yönetmeliği'nin ilgili maddeleri incelenmiştir.
